When do you get compensation for delayed flight?

In order to qualify for compensation under EC 261 and UK 261/2004, several requirements must be met:


•your destination arrival time was delayed by more than 3 hours


•your flight departed from an EU/UK airport or arrived in the EU/UK


•you checked in on time for your departing flight


•the delay was the fault of the airline and not due to an extraordinary circumstance



If your situation meets the above criteria, you may be eligible for compensation, which can reach up to €600/£520.

What are my rights in the case of flight delays?

In addition to compensation, airlines are also obligated to provide certain assistance if your flight has been delayed by more than three hours. Your flight delay rights typically include: 


  • Refreshments and Meals: Airlines should offer you food and drinks during the delay, particularly if you are waiting for several hours.


  • Communication: You should be provided with free access to communications, including phone calls or emails, to inform others of your delay.


  • Accommodation: If the delay requires you to stay overnight, the airline must arrange and cover the cost of accommodation.


  • Transport to Accommodation: The airline is responsible for transportation to and from the hotel, if overnight stay is necessary.


  • Alternative Flights: If your flight is significantly delayed, airlines should offer you the option of rebooking on an alternative flight at no extra charge.

How is flight delay compensation calculated?

The potential compensation amount is based on the length of the delay and total distance of the flight. Remember, you can only claim compensation if flight was delayed by 3 hours.


In the event that your flight was delayed by less than 3 hours, you cannot claim compensation, however, the airline will provide care.


Please note:

If your overall journey (departing location to final arrival destination) contains multiple legs/layovers, your compensation amount will be based on the entire journey distance.

What if your flight was delayed by less than 3 hours?

In the event that you have had a flight delayed by 2 hours or more, the airline will provide you with free food and drinks.


Normally, vouchers would be presented to you at the check in counter and these can be used at any restaurant, cafe or food shop within the airport.


It is important to remember that if your 2 hour delay turns into 3 hours, you are entitled to compensation and the vouchers alone will not be suffice.

In which extraordinary circumstances can't you make a claim?

While passengers have rights to compensation for flight delays under EU261, there are certain situations deemed "extraordinary circumstances" where compensation is not required. These scenarios are typically beyond the airline's control and can include:


Severe Weather Conditions: Extreme weather such as heavy snow, storms, or natural disasters that significantly disrupt flight schedules. If you have had a flight delayed due to weather (severe) weather conditions, you cannot make a claim.


Air Traffic Control Issues: Situations where air traffic control imposes restrictions or delays affecting multiple flights, which the airline cannot influence.


Security Risks: Unforeseen security threats or incidents that lead to increased screening or delays.


Medical emergencies: If there has been a medical emergency with someone on the plane, before the flight has taken off, you will not receive compensation.


Basically, you cannot claim compensation if the airline faces any issues that they were not able to prevent or is out of their control.

Validity period for fight delay compensation claims

You may be wondering if you are are still eligible for compensation for compensation if you had a flight delay over 3 hours more than a year ago.


Luckily for you, as long as the delay you experienced happened in the last 6 years and you departed from/arrived in the EU or the UK, your claim is still valid. It does not have to date exactly 6 years ago from the current date but 6 years ago from the current year.


Bare in mind-there is a higher rate of success the earlier you start your claim. Why wait?

Collect all flight details of everyone on your booking. This includes:


- names

- booking confirmation email

- delay notification from the airline 

- booking reference number

- flight number
